Terms of Service

1. Acceptance of Terms

By accessing or using any Axios Studio product ("we", "us", "our"), you agree to these Terms of Service. If you do not agree, please do not use our services.

2. Description of Services

Axios Studio offers digital products under a SaaS (Software as a Service) model, including:

• FlowBot - No-code chatbot platform for WhatsApp, Instagram, TikTok, YouTube and LinkedIn, with AI-powered flows and content publishing
• Juntos com Saúde - Intelligent health diary
• Pet Memories - Pet memory journal with AI-powered emotional support
• Volta que Ganha - Digital loyalty card system for merchants
• AxioAgenda (formerly Da Pra Marcar) - Professional scheduling system for beauty and wellness professionals, with an optional AI assistant on WhatsApp
• Axios Shop - Commerce platform for retailers
• Organizei - Take a photo. Organized. AI-powered automatic organization
• Plantel - Management system for passerine breeders
• Postei - Social media content scheduling and publishing
• Axios NFe - Electronic fiscal document issuance (NF-e / NFC-e)
• DaPraPagar - Billing and payment management for groups

3. Registration and Account

To use our services you need a valid Google account. By signing in, you confirm that the information provided is truthful. You are responsible for maintaining the security of your account.

4. Plans and Payments

Some products offer free plans with limited functionality and paid plans with additional features. Payments are processed through Stripe. When you subscribe to a paid plan:

• Billing is recurring (monthly) and will renew automatically
• You can cancel at any time through the product dashboard
• On cancellation, you retain access until the end of the period already paid for
• We do not offer refunds for partial periods

5. AI Credits and One-Time Packages

Some products use AI credits for advanced features:

• Plan credits renew monthly and do not accumulate
• One-time credits purchased separately never expire
• Credits are not transferable between accounts or products
• Credits are non-refundable

6. FlowBot and Connected Channels

When using FlowBot, you authorize us to connect your social channels (WhatsApp Business, Instagram, TikTok, YouTube, LinkedIn) via each platform's official OAuth. You agree to:

• Comply with the Terms of Service of each connected platform (Meta, TikTok, Google, LinkedIn)
• Only send messages to users who have opted in and have an open messaging window (per WhatsApp Business Policy and equivalent)
• Not use the platform to send spam, phishing, harassment or illegal content
• Respect end-user opt-out requests
• Take responsibility for the content you publish through connected channels

Axios Studio is a technology provider; you remain the data controller of your customer/audience data.

7. Acceptable Use

You agree not to:

• Use the services for illegal or unauthorized activities
• Attempt to access data of other users
• Reverse engineer or copy our software
• Intentionally overload our servers
• Share your account with third parties
• Impersonate anyone or misrepresent your affiliation

8. Intellectual Property

All content, design, code and trademarks of the products are owned by Axios Studio. Content generated by you (texts, data, media) remains yours. We only store and process it as needed to deliver the service.

9. Privacy and Data

Your data is securely stored on Firebase (Google Cloud) and Supabase with encryption. We do not sell, share or disclose your personal data to third parties, except when required by law. For details, see our Privacy Policy.

10. Disclaimers

• Juntos com Saúde: We are not healthcare professionals. The app is an organization assistant and does not replace medical consultations.
• Pet Memories: AI-powered emotional support does not replace professional psychological care.
• FlowBot: Messages sent to end customers are the user's responsibility. Compliance with each platform's policies (Meta, TikTok, Google, LinkedIn) is the account owner's responsibility.

11. Availability

We will strive to keep services available 24/7, but we do not guarantee uninterrupted availability. We may perform scheduled or emergency maintenance without prior notice.

12. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting our support.

13. Changes to the Terms

We may update these terms from time to time. Significant changes will be communicated via email or inside the products. Continued use after changes constitutes acceptance of the new terms.

14. Price Adjustment

Plan prices are automatically adjusted in January of each year, based on the accumulated variation of the IPCA (Brazilian Consumer Price Index) for the previous year, as published by IBGE, per Brazilian Laws 9.069/95, 10.192/2001 and Article 317 of the Civil Code. The adjustment is automatic and requires no prior notice. In case of deflation (negative IPCA), prices remain unchanged. By using the services, the user acknowledges and agrees with the automatic annual adjustment.

15. Data Protection (LGPD)

Axios Studio operates in compliance with Brazil's General Data Protection Law (LGPD - Law 13.709/2018). Your personal data is processed exclusively to provide the contracted services. You have the right to access, correct or delete your personal data, withdraw consent and request portability. To exercise your rights, contact us at the email below.

17. Governing Law

These terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be resolved in the courts of Indaial/SC, Brazil.
